Otherwise your argument would be correct but you are paying for the right to use the software, not ownership of the software. I think that all the lawyers out there would be pretty silly to make EULAs if they weren't legal.</description>

If that was referring to the creator(s) of the program, then the law would be saying that the creator(s) of a program could only use their software, not give/sell it to others.

Also, in part b that you mentioned, it says that you may do those things as part of a 'transfer of all rights in the program' (i.e., selling the entire program and all copies).

Furthermore, at the end of part b, the creator of the application is referred to as 'the copyright owner' not 'the owner of a copy' as you are postulating.

Just to clarify, I become the 'owner of a copy' of the computer program as soon as I buy it from the [store, website, whatever] as I now own a disc that contains a copy of the software.  If that was not true, the disc would belong to M$ (or more generally, the 'copyright owner').  Hence, I am granted certain rights under the law that cannot be taken away by the 'copyright owner' (according to consumer protection laws).</description>
